To simplify and streamline our communications, we will use the term “Members” to refer to all these professionals.

Members can showcase their information and expertise on the MusiciaNow app by subscribing to a monthly or annual membership, with no additional fees or commissions. This allows them to offer their services to other Members or to occasional clients.

For Clients:

MusiciaNow is an application that enables anyone to easily find a musician, a DJ for a private party, a booking manager for an artist, or a sound or lighting technician/engineer for a specific event.

Guest clients or subscribed clients (with an affordable fixed-rate plan) can use the app to quickly find the artist or professional that best suits their needs.

For Members:

MusiciaNow offers an exceptional platform that allows Members to promote themselves worldwide at an extremely affordable cost.
Each Member can create a professional profile and offer their services to a clientele looking for specific talents.

Our platform is flexible, professional, and allows targeted searches using various filters, making it easier to find the perfect artist or specialist for any occasion.

This Privacy Policy describes how MusiciaNow collects, uses, protects, and discloses your personal data, collected with your consent during your use of our services.
This includes the use of our website, mobile application, newsletters, blogs, programs, and any other platform or medium we offer.

By accessing or using our services, you acknowledge that your personal data (including data collected through the website or application) may be collected, stored, shared, and processed in accordance with this Privacy Policy.

Our site may contain links to third-party websites or applications. Please note that these platforms may collect information about you and have their own privacy policies.

What Personal Data Do We Collect?

We may collect the following personal data about you. Please note that we may combine personal data about you from different sources.

We collect the personal data you voluntarily provide, for example, when you create an account on our website and/or application (including registration as a user, or through our seller portal, provider portal, or affiliate program).

The personal data you voluntarily provide includes information submitted when creating an account and during interactions (e.g., reviews, feedback, testimonials, comments, including on our blogs).

This personal data may include your name, email address, other contact details, login/account information, marketing information, marketing preferences, and any other information you may provide in your account profile.

This personal data may also include your name and contact information, photos you choose to upload, and any other personal data you choose to provide in connection with your postings.

We do not have access to the photos on your device or camera unless you authorize us to do so. If you grant us permission, you can manage your photos and camera settings at any time by adjusting the settings on your mobile device.

Please note that any personal data you choose to publish in a testimonial, feedback, review, or comment may be read, collected, and used by others. Therefore, please avoid posting any content that you do not wish to make publicly available.

Correspondence

We collect personal data when you contact us or when we contact you, and we generally keep a record of such correspondence. This personal data may include your name and contact details, your account and order information, your inquiries, and any other personal data you may choose to provide to us.

Order and Transaction Information

MusiciaNow may retain personal data when you place an order and complete a transaction. However, at no time do we use or share your information other than to notify the merchants from whom you purchased a product or service.

Registration

MusiciaNow collects the personal data you voluntarily provide when you register on the MusiciaNow application as a Lifetime Member or Client through a subscription.

This personal data may include your name, email address, other contact information, login/account information, information about your school, your marketing preferences, and any other information you may choose to provide.

Credit Information and Fraud Prevention

MusiciaNow does not request any personal data related to your financial situation, creditworthiness, or any criminal or fraudulent activities reported to us by you or third parties. This includes information used to verify your identity (such as driver’s licenses, passports, and utility bills), transaction information, credit ratings from credit reference agencies, fraud records, offenses, and suspicious transactions when your contact details are included.

Social Media Information

 We are active on social media platforms, including but not limited to Facebook, Instagram, TikTok, and YouTube. We collect personal data when you interact with us on these platforms. Please note that these social media platforms may place cookies and other trackers on your device when you visit or navigate from their pages.

The resulting information may be provided to us (typically for statistical purposes to understand how users interact with our content on social media platforms). These social media platforms are also responsible for processing your personal data. Information about how they collect and use your personal data (including how they use cookies and other technologies, and instructions on how you can opt out) can usually be found on their respective websites under their Privacy and Cookie Policies.

NB: At no time can MusiciaNow be held responsible for the information you share on social networks.

 

Information about surveys and contests
MusiciaNow collects personal data when you respond to surveys that we may use only for statistical purposes and when you choose to participate in competitions we run. This personal data may include your name and contact information, as well as other personal data you may choose to provide to us. MusiciaNow never shares your information.

Information stored on a device

We CANNOT access metadata and other information associated with other files stored on your computer, tablet, mobile phone, or other device (collectively, “Device”), such as IP address, domain name, browser version and operating system, traffic data, web logs, and other communication data, as well as device identifiers.

Furthermore, we CANNOT collect photos, videos, Touch ID and Face ID login features, or session identifiers for third-party service providers such as payment providers (“Device Information”).

To the extent required by applicable law, we will ask for your consent before collecting device information.

Please note that we have no interest in your device information.

Location information

With your permission, which you may provide when you install our mobile application or when you access and use our mobile application, we may collect information about a device’s general location.

On our Application, you have the option to use the geolocation feature to facilitate your searches. Please note that this geolocation is approximate and is intended to offer you available profiles in your target geographic area.

In addition, if a Member activates the “LIVE” geolocation option, they can report their presence in real time outside their residential area. This allows them to access expanded contract opportunities, wherever they are, and optimize their visibility among new customers.

This feature is designed to enrich the user experience and increase collaboration opportunities.

Collection and Use of Public Information

MusiciaNow has no interest in collecting, using, storing, transferring, sharing and disclosing your publicly available personal data for the purposes set out in this Privacy Policy.

MusiciaNow and Children

Our app is primarily intended for an adult audience, although it is not exclusively for them. MusiciaNow may occasionally offer products aimed at young people, such as t-shirts, caps, or other promotional items.

However, we do not knowingly or intentionally collect personal data from children. All products intended for a younger audience are available for purchase by adults only.

We ask that you only use the website or app if you are 18 years of age or older. By accessing our services, you confirm that you are of legal age to use our services.

Why do we use your personal data?

We may use your personal data for various purposes, which we have described below.

To conduct our business and to facilitate the use of our services and access to our website.

To conduct our business, including enabling you to use our services and website, responding to your inquiries, fulfilling our obligations arising from any agreements entered into with you, and contacting you in connection with the foregoing. This EXCLUDES the processing and fulfillment of your orders, returns, and exchanges, and providing you with information and updates pertaining to your orders and account.

To manage your account and subscriptions

You must register as a Member or Lifetime Customer on our App to manage your account and subscriptions and to receive the benefits associated with your use of the MusiciaNow App.

You may communicate with us (regarding updates and changes) and have access to support for your requests, comments, questions, or concerns. You may contact us if you have any issues with your account. These communications are provided through various means, including email, text messages, and device push notifications (when enabled). Calls may be recorded for training and monitoring purposes.

MusiciaNow does not offer transactions between Members or between Lifetime Customers and Members.

MusiciaNow is here to facilitate interactions between Members and Lifetime Customers and Members.

MusiciaNow is here to provide increased visibility to help professionals find work opportunities worldwide.

Fraud prevention

As required by applicable laws and regulations and best practices at any time. If false or inaccurate information is provided and fraud is identified or suspected, this information may be passed to fraud prevention agencies and may be recorded by them or by us.

Interactive functions

MusiciaNow allows Members and Lifetime Customers to leave messages via the Contact form, leave reviews, and chat.

NB: Testimonials, reviews, and comments can be read, collected, and used by anyone.

Security of our Application

MusiciaNow ensures that the content and features of our tool are presented in the most efficient and secure way possible.

Research and Development

Through its App and website, MusiciaNow strives to better understand your needs as a Member and Lifetime Customer. To do this, we may apply profiles based on personal data and behavioral information (such as the App and website pages you have visited or interacted with, including personal data obtained and shared voluntarily by you and that is publicly available). These profiles may be used for our advertising, analytics, security, and support activities.

MusiciaNow may provide you with promotional materials, updates, and offers when you have opted in.

Members with whom you have done business may also use your information to offer you other opportunities based on your approval.

MusiciaNow will not use your personal data for marketing purposes via social media. Our goal is to bring Members and Lifetime Customers closer to Members.

If you subscribe to our newsletter, please note that you can opt out of receiving promotional emails at any time by clicking the “Unsubscribe” link at the bottom of all MusiciaNow promotional emails or by sending an email to support@musicianow.com with the subject line: “Unsubscribe.”

If you are a registered MusiciaNow Member or Lifetime Customer, you can also opt out of receiving promotional emails by updating your preferences in the “Email Notifications” section of your account.

NB: Please allow up to thirty (30) days to process your request if you opted out manually instead of using the unsubscribe link in one of our newsletters.

Please also note that even if you opt out of receiving newsletter emails, you may still receive communications from us that are important and/or related to your interactions with us, or as otherwise required by law.

Please also note that our marketing emails may contain a unique campaign “web beacon” to let us know how you interact with our communications. We may use this information to determine, among other things, which of our emails are of most interest to you and whether you should continue to receive emails if you do not open them. The web beacon will be deleted when you delete the email.

If you do not want the web beacon downloaded to your device, you must opt ​​out of email marketing or view emails in plain text format.

Mobile Apps and Website Analytics

To understand and analyze your online experiences and determine which events, products, and services may be of interest to you, we may combine information about your visitor session or other information collected by tracking technologies (whether you are logged in or not) with personal data.

When you consent to the use of your location data, some mobile applications may use location data. MusiciaNow does not do this.

To enforce our Terms and Conditions and as part of legal or regulatory obligations, we may process your personal data to enforce our Terms and Conditions and comply with our legal and regulatory requirements, or to communicate with regulatory authorities, judicial proceedings, or court orders, as applicable. This may include disclosing your personal data to third parties, judicial authorities, and/or regulatory authorities or law enforcement agencies in connection with inquiries, proceedings, or investigations conducted by such parties anywhere in the world, or when required to do so.

Reorganization or modification of our activity

In the event that we:

i- are negotiating the sale of our business or part of it to a third party;

ii- the amounts transferred to a third party; or

iii- are undergoing a reorganization,

We may transfer all or part of your personal data to the relevant third party (or their advisors) as part of a due diligence process to analyze any proposed transfer or reorganization. We may also need to transfer your personal data to this reorganized entity or a third party after the transfer or reorganization for them to use for the same purposes as those set out in this policy.

MusiciaNow does not use other tracking technologies that exist on the web or on its Application.

For example:

  • Web beacons and pixels
  • Application SDKs and advertising identifiers
  • “Do Not Track” features

Some web browsers have a “Do Not Track” feature that, when enabled, signals to websites the user is visiting that they do not want to be tracked. Currently, the Site does not respond to “Do Not Track” features or similar mechanisms.

Who do we share your personal data with and for what purpose?

Affiliated companies

We may share the personal data we collect about you with all MusiciaNow subsidiaries and affiliates.

As our business evolves, we may acquire, establish, or sell business units or subsidiaries. Customer data is one of the business assets transferred in such a transaction. In such a transaction, your personal data would only be used in accordance with this Privacy Policy.

Third Parties (In accordance with law or regulations)

We may disclose your personal data when required to do so by law or regulation and when we believe that such disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order or legal process served on MusiciaNow.

Collection and Use of Non-Personal Information

We may collect, use, store, transfer, share and disclose non-personal information for any purpose (subject to applicable law).

How do we protect your personal data?

Security

No data transmission over the Internet, websites, or applications can be guaranteed to be secure against intrusion. However, MusiciaNow uses commercially reasonable efforts to protect its customers’ personal data. If you would like your financial information (including your payment card details (such as card number, CVV2, expiration date) and corresponding billing information (such as billing address, phone number, billing address, billing contact) to be deleted at the time of your order, you can choose to have your financial information deleted from our records at the end of your order.

Alternatively, you can contact us at support@musicianow.com to request that your financial information be deleted from our database. For any future transactions, you will need to re-enter your information.

To ensure the confidentiality of your username and password, we ask that you NOT share this information with anyone.

How long do we keep your personal data?

Our retention periods for personal data depend on both business needs and legal requirements.

We will retain your personal data for as long as we use it for the purposes described in the sections above. We may continue to retain it after we have ceased to use it for certain legitimate business purposes. For example, if you have opted out of receiving marketing communications from us, we will retain a limited amount of your details to ensure we are able to honor your opt-out request. We may also continue to retain your personal data to meet our legal requirements or to defend or exercise our legal rights.

The length of time we retain your personal data will depend on the purposes for which we need to retain it. When we no longer need to retain it, we will securely delete or destroy it in accordance with our document retention policy.

What are your rights?

When you submit a request to exercise your rights, we must verify that you are entitled to them before responding to a request. Please note that your rights may be subject to certain exceptions provided for by the applicable data protection law(s).

How to modify or consult your information and preferences?

You may change or view your account information and settings for the following reasons:

Account Info

When you register for a MusiciaNow account:

1) You can enter your email address and password. This email address is your MusiciaNow ID and the email address you use to log in to the App. To change your email address and MusiciaNow ID on our website, please go to Account Settings.

You cannot change your email address and MusiciaNow ID from the MusiciaNow mobile app or website. Please note that you must have your MusiciaNow email address/username and password to access your account.

2) You can also register using your Google ID. We may add a Facebook ID in a future version of the App.

Commercial communication

You can opt out of receiving marketing communications, special offers, and updates by clicking the appropriate box.

If you currently receive marketing communications, special offers, and updates and wish to no longer receive them, MusiciaNow offers several ways to do so. If you are a registered user, you can manage your marketing communication preferences through your account settings. Additionally, you can email support@musicianow.com with a removal request, or contact us as described in the section above.

You can also use the link provided in all MusiciaNow marketing communications to automatically unsubscribe.

Please note that you may still receive non-marketing service-related communications.

How to change or view your technical preferences?

Cookie settings

– You can manage cookies through your browser settings.

Push notifications

– If you are currently receiving “push notifications” and wish to stop receiving them, you can turn off these notifications at any time by changing the settings on your mobile device.

Uninstall the mobile app

– You can stop any further collection of information by our mobile application by uninstalling it. You can use the standard uninstallation process to remove it from your mobile device.

Updates to this Privacy Policy

We regularly review and occasionally update this Privacy Policy as our services and use of personal data change. If these changes are material, we will take steps to notify you.

We will update the date of this document whenever it changes.
