Clear rules for using MusiciaNow.

These Terms and Conditions (“Terms”) govern your access to and use of the MusiciaNow mobile applications for iOS and Android, the MusiciaNow website, and related features and services (collectively, the “Service”).

By creating an account, accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

You must be at least 18 years of age and legally capable of entering into a binding agreement to use MusiciaNow. By using the Service, you represent that you meet these requirements.

Certain features require an account. You agree to provide accurate, current and complete information, keep your login credentials secure, and promptly update information when necessary.

You are responsible for activity that occurs under your account. Please notify us promptly if you believe your account has been accessed or used without authorization.

Any agreement, booking, payment arrangement, performance obligation or other transaction between users is made directly between those users.

Certain features of MusiciaNow require a paid subscription.

MusiciaNow does not control refund decisions made by Apple or Google. Refund requests for purchases made through those platforms are subject to their respective policies.

You retain ownership of content you submit, upload, post or otherwise make available through MusiciaNow (“User Content”).

By providing User Content, you grant MusiciaNow a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and otherwise use that content only as reasonably necessary to operate, provide, secure, improve and promote the Service.

You represent that you own or have permission to use the content you provide and that your content does not violate applicable law or the rights of another person.

MusiciaNow may provide chat and messaging tools to facilitate communication between users. You are responsible for your communications and interactions.

MusiciaNow does not actively monitor every communication, but may review reported content, remove or restrict content, or suspend or terminate accounts when reasonably necessary to enforce these Terms, protect users or comply with law.

Users are responsible for exercising reasonable judgment and caution when communicating, meeting, hiring, performing for or otherwise interacting with other users.

MusiciaNow is not responsible for the conduct of users outside the Service, the truth or accuracy of information supplied by users, disputes between users, or the outcome of any engagement, transaction or relationship.

You agree not to misuse the Service or interfere with its normal operation. Prohibited conduct includes attempting to bypass access controls, probe or compromise security, reverse engineer protected portions of the Service except where permitted by law, use automated means in a manner that burdens or disrupts the Service, or use MusiciaNow for unlawful or unauthorized purposes.

MusiciaNow’s trademarks, logos, software, designs, interfaces, branding and original content, excluding User Content, are owned by MusiciaNow or its licensors and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute or use MusiciaNow intellectual property except as permitted by law or with our prior written permission.

Our Privacy Policy explains how MusiciaNow collects, uses, shares and protects personal information. Your use of the Service is also subject to that Policy.

You may stop using MusiciaNow at any time. Where available, you may also request deletion of your account.

MusiciaNow may suspend, restrict or terminate access when we reasonably believe a user has violated these Terms, created a risk to users or the Service, engaged in fraud or abuse, or when suspension or termination is required by law.

Provisions that by their nature should survive termination, including intellectual-property, disclaimer, liability and dispute-related provisions, will continue to apply.

The Service is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that MusiciaNow will always be uninterrupted, error-free or available in every location, or that user-provided information will always be accurate, complete or current.

Visible availability is an Artist-controlled signal and does not guarantee that an Artist will accept an opportunity, remain available, meet a particular qualification or enter into an agreement with another user.

To the maximum extent permitted by applicable law, MusiciaNow will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost income, profits, business, reputation or opportunities arising from or related to the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold MusiciaNow harmless from third-party claims, losses, liabilities and reasonable expenses arising from your unlawful use of the Service, your User Content, or your material breach of these Terms or the rights of another person.

We may revise these Terms as MusiciaNow, its features, business model or legal requirements evolve. When changes are made, we will update the revision date and provide additional notice where required by law.

Your continued use of the Service after revised Terms become effective constitutes acceptance of those revised Terms, subject to any additional consent requirements imposed by applicable law.

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable in Québec, without regard to conflict-of-law principles, except where mandatory consumer or other applicable law provides otherwise.

Subject to applicable mandatory law, disputes relating to these Terms or the Service will be submitted to the competent courts of Québec, Canada.
