Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the MusiciaNow mobile application, website, and related services (collectively, the “Service”), operated by MusiciaNow (“MusiciaNow”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, available at: https://musicianow.com/en/privacy-policy/

If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use the Service. By using MusiciaNow, you represent and warrant that you meet this requirement and that you are legally capable of entering into a binding agreement.

2. Account Registration and Security

To access certain features, you must create an account. You agree to:

    • Provide accurate, current, and complete information
    • Maintain the confidentiality of your login credentials
    • Be fully responsible for all activities under your account

You agree to notify us immediately of any unauthorized use or security breach. MusiciaNow is not liable for losses caused by unauthorized access resulting from your failure to safeguard your credentials.

3. Description of the Service

MusiciaNow is a digital platform that enables musicians, DJs, technicians, booking managers, and venues to connect, communicate, and engage for professional opportunities.

MusiciaNow does not employ users, does not guarantee bookings, and does not act as an agent, broker, or employer. All agreements and transactions are made directly between users.

4. Subscriptions, Payments, and Billing

Certain features of the Service may require a paid subscription.

a) Billing Platforms

    • On iOS, subscriptions are processed through Apple In-App Purchases
    • On Android, subscriptions are processed through Google Play Billing
    • On the web, payments may be processed through third-party providers such as Stripe

Pricing, billing cycles, renewal terms, and cancellation options are disclosed at the time of purchase.

b) Auto-Renewal

Subscriptions renew automatically unless canceled prior to the renewal date through the platform where the subscription was purchased.

c) Refunds

Refunds are subject to the policies of Apple, Google, or the applicable payment processor. MusiciaNow does not control refund decisions made by third-party platforms.

5. User Content

You retain ownership of any content you submit, post, or display on the Service (“User Content”).

By submitting User Content, you grant MusiciaNow a non-exclusive, worldwide, royalty-free, transferable license to host, store, display, distribute, and make your content available solely for the operation, promotion, and improvement of the Service.

You represent that:

    • You own or have the necessary rights to your content
    • Your content does not infringe third-party rights
    • Your content complies with these Terms and applicable laws

6.Chat, Messaging, and Community Conduct

MusiciaNow provides chat and messaging features to facilitate communication between users.

a) Prohibited Conduct

You agree not to post, send, or share content that is:

    • Harassing, threatening, abusive, hateful, or discriminatory
    • Sexually explicit or exploitative
    • Fraudulent, misleading, or impersonating another person
    • Defamatory or invasive of privacy
    • Illegal or encouraging illegal activity
    • Spam, unsolicited promotions, or malicious links

b) Monitoring and Enforcement

MusiciaNow does not actively monitor all communications, however, reserves the right to:

    • Review reported content
    • Remove or restrict access to content
    • Suspend or terminate accounts that violate these Terms

Repeated or severe violations may result in permanent account removal without notice.

c) User Safety

Users are responsible for exercising good judgment and caution when interacting with others. MusiciaNow is not responsible for offline interactions, disputes, or outcomes arising from user communications.

7. Acceptable Use

You agree not to:

    • Reverse engineer, copy, or exploit the Service
    • Circumvent security or access controls
    • Use the Service for unlawful or unauthorized purposes
    • Interfere with the Service’s operation or infrastructure

8. Intellectual Property

All trademarks, logos, software, designs, and content provided by MusiciaNow (excluding User Content) are the exclusive property of MusiciaNow and protected by intellectual property laws.

You may not use our intellectual property without prior written consent.

9. Privacy and Data Use

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, store, and share personal data.

By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Termination

We may suspend or terminate your account at any time if:

    • You violate these Terms
    • Your conduct poses a risk to users or the platform
    • Required by law or regulatory authorities

You may stop using the Service at any time. Certain provisions of these Terms will survive termination.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
We make no warranties regarding availability, reliability, accuracy, or suitability for your specific needs.

MusiciaNow does not guarantee that the Service will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, MusiciaNow shall not be liable for:

    • Lost income, profits, or opportunities
    • User disputes or failed engagements
    • Indirect, incidental, or consequential damages

13. Indemnification

You agree to indemnify and hold harmless MusiciaNow from any claims, damages, losses, or expenses arising from:

    • Your use of the Service
    • Your User Content
    • Your violation of these Terms or applicable laws

14. Modifications to the Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Québec, Canada, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts located in Québec, Canada.
