Terms and Conditions

1.  Acceptance of Terms

By downloading, installing, or using MusiciaNow (the “Service”), you agree to be bound by these Terms of Service (“Terms”), all applicable laws and regulations, and you are responsible for compliance with any local laws. If you do not agree with these terms, do not use the Service.

2.  Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. By creating an account, you represent that you meet these requirements.

3.  Account Registration

You are responsible for safeguarding your login credentials. You agree to provide accurate information and update it as needed.

4.  Subscriptions & Payments

  • **Plans & Free Trial** – Providers may purchase monthly or annual subscriptions. Eligible new users may receive a free‑trial period; you will be charged automatically at the end of the trial unless you cancel before it expires.
  • **Billing processor** – All payments are processed securely via **Stripe**. We never store full card numbers on our servers.
  • **Upgrades & Downgrades** – If you change from a monthly to an annual plan (upgrade), the change takes effect immediately and the unused portion of your current period is pro‑rated toward the new price. If you downgrade (annual → monthly), the downgrade takes effect at the end of your current billing cycle.
  • **Renewal** – Subscriptions renew automatically at the end of each billing cycle unless cancelled at least 24 hours before renewal.
  • **Cancellation & Refunds** – You may cancel at any time from within your account settings. Service remains available until the end of the paid period.

    **No refunds** are provided for partial months, unused time, or downgrades, except where required by law.

  • **Taxes** – Prices exclude applicable taxes; Stripe calculates and remits taxes where required.
  • **Failed payments** – If your payment method is declined, we may retry or suspend access until payment is received.

5.  Service Rules

You agree **not** to:

  1. Post false, defamatory, obscene, or infringing content.
  2. Violate any law or third‑party right.
  3. Use the Service for unauthorized commercial purposes or spam.
  4. Misrepresent your identity, skills, or availability.
  5. Reverse engineer, decompile, or scrape the Service.

6.  User Content

  • **Ownership** – You retain ownership of content you upload (audio demos, images, text).
  • **License to MusiciaNow** – You grant us a worldwide, non‑exclusive, royalty‑free license to host, display, and distribute your content within the Service.
  • **Community Guidelines** – Content must be accurate, respectful, and lawful.

7.  Intellectual Property

MusiciaNow and its logo are trademarks of Jean Leslie Jedrychowski. All software, text, graphics, and other materials are owned by or licensed to MusiciaNow and are protected by intellectual‑property laws.

8.  Disclaimers

MusiciaNow and its affiliates are not responsible for the quality of work, payments, or any other issues between Clients and Members (including Musicians, DJs, Technicians, Booking Managers, Venue Owners, etc.). MusiciaNow acts solely as a neutral platform and will not be involved in any disputes between users.

Profiles and listings are user-generated, and MusiciaNow does not guarantee the accuracy of the information presented.

9.  Limitation of Liability

To the fullest extent permitted by law, MusiciaNow and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the Service.

10.  Indemnification

You agree to indemnify and hold harmless MusiciaNow, its directors, officers, and employees from any claim arising out of your breach of these Terms or your misuse of the Service.

11.  Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Québec and the laws of Canada applicable therein, without regard to conflict‑of‑law principles. Any dispute will be submitted to the exclusive jurisdiction of the competent courts in Montréal, Québec, unless local consumer‑protection laws require otherwise.

12.  Modifications to Terms

We may modify these Terms at any time. Material changes will be notified via email or in‑app notice. Continued use after changes constitutes acceptance.

13.  Termination

We may terminate or suspend access to the Service immediately, without prior notice, for breach of these Terms. You may terminate by deleting your account and uninstalling the app.
